Do you need a Hague apostille for a power of attorney notarized in the State of Florida?
Situations may arize when you need someone to act on your behalf in a foreign country. An apostilled power of attorney (or legalized / authenticated by an embassy, in case the power of attorney will be used in a non-Hague country), will serve this purpose.
What is a power of attorney? This is a document that grants another person the power to handle business or personal affairs on behalf of the signer.
In all cases, the power of attorney must have the original signature of the signer and a proper notarization by a notary commissioned in the State of Florida.
An apostille will authenticate the signature of a Florida notary public on the power of attorney.
If your document was signed and notarized in a different state, an apostille should be obtained from that state. For example, if you signed the power of attorney in New York, it can only be apostilled in New York.
In order to get an apostille for your power of attorney, you will need to mail the original notarized power of attorney to our office for processing. Emailed copies are not eligible for Florida apostilles.
Remotely notarized powers of attorneys cannot be apostilled because the original signatures of both the signer and the notary are required for apostille purposes.

What does a Florida apostille look like?
Can a remotely notarized document be apostilled in Florida?
No. For apostille purposes, only the original signature of the signer and the original signature of the notary who notarized the document are acceptable.
Request a sample POA from the country of intended use
We strongly recommend to obtain a sample power of attorney from the country of intended use, tailor it to your needs, and then sign, have it notarized and apostilled. For example, if your power of attorney is intended for Mexico, a Mexican attorney should draft the document for you (either in Spanish or in English, or both). For apostille purposes, the State of Florida allows documents in foreign languages, provided that the notarial statement (acknowledgment or jurat) is in English. Please note that, for apostille purposes, in a Spanish document the words "notario publico" are not allowed by most Secretaries of State, including the State of Florida.
