Power of attorney apostille

Do you need a Hague apostille for a power of attorney? Start here...

Getting an apostille for a power of attorney (POA) in the United States requires careful attention to each state’s specific rules, particularly around notarization. All states require the power of attorney document to be notarized before it can be authenticated, and some states now accept remote notarization in addition to traditional in-person notarization. The issuing authority and required steps can vary depending on where the document was signed and notarized. This page provides a state-by-state overview of apostille requirements for powers of attorney, including notarization guidelines, to help you complete the process correctly and without confusion.

California

California apostille requirements for powers of attorney

california power of attorney apostille

To be eligible for California apostilles, powers of attorney (POA) must be properly notarized by a California notary public and must contain an acknowledgment.

An acknowledgment confirms that the signer personally appeared before the notary, was properly identified, and declared that they willingly signed the document. While the document can be signed before the notary appointment, the signer must still appear in person to confirm the signature.

Here is a sample California Certificate of acknowledgment.

tip apostilleOnly the signer's printed name should appear on the acknowledgment form. No title, no signer's signature.

tip apostille The acknowledgment can be on a separate page or printed on the document.

importantRemotely notarized documents: California law requires a person to appear personally before a notary public to obtain notarial acts like acknowledgments or jurats. This means the party must be physically present before the notary public. A video image or other form of non-physical representation is not a personal appearance in front of a notary public under current California State law.

importantElectronically notarized documents: California notaries public are authorized under current law to perform notarizations on documents electronically as long as all the requirements for a traditional paper-based notarial act are met, including the use of a seal for all but two specific documents used in real estate transactions.

important If multiple individuals are signing the document, the notary should notarize each signature.

The notary seal must include the notary's name as it appears on their certificate of appointment, the words "Notary Public" and "Connecticut".

When using the seal, the impression should be affixed near, but not over, the notary's signature. New York

New York apostille requirements for personal Powers of Attorney (POA)

new york power of attorney apostille

How do you prepare a Power of Attorney for foreign use? Here are the general guidelines...

apostille acceptable Your document can be a notarized original or it can be signed and notarized electronically / remotely.
apostille acceptable Your document must have a date.
apostille acceptable If there are more than one signer, the notary should indicate whose dignature he/she is notarizing.
apostille acceptable There must be no corrections or blanks.
apostille acceptable The signature(s) must be properly notarized by a New York notary public.
apostille acceptable The document may be in a foreign language, no translation is required. The notary's statement must be in English.

In the State of New York the authentication of documents such as powers of attorney, affidavits, authorizations, consents is a three step process. First, your signature on the document needs to be notarized. Then, the signature of the notary needs to be authenticated by the County Clerk's office in the county where the notary is commissioned. And only then, the document is submitted to the Secretary of State who either attaches an apostille (if the country of intended use joined the Hague Apostille Convention) or a foreign certification (if the document is intended for a non-Hague country).

If your document was singed and notarized in a different state, an apostille should be obtained from that state. For example, if you signed the power of attorney in California, it can only be apostilled in California.

Remotely notarized powers of attorneys have specific requirements. Read more about the apostille requirements for notarized documents (including the requirements for remote notarization) in the State of New York.....

Free document evaluationWe recommend that you email a copy of your Power of Attorney for a free evaluation. We will advise if the document has been notarized properly, if the notary is active, and if the document is eligible for an apostille / legalization.

Request a sample POA from the country of intended use

General 6We strongly recommend to obtain a sample power of attorney from the country of intended use, tailor it to your needs, and then sign, have it notarized and apostilled. For example, if your power of attorney is intended for Mexico, a Mexican attorney should draft the document for you (either in Spanish or in English, or both). For apostille purposes, the State of New York allows documents in foreign languages, provided that the notarial statement (acknowledgment) (see below) is in English. Please note that, for apostille purposes, in a Spanish document the words "notario publico" are not allowed by most County Clerks in the State of New York.

Email a copy of your notarized power of attorney for a free evaluation.

What does a "proper notarization" mean?

Please note that for apostille purposes the contents of the document is not important. What is important is the way the document is notarized. We will check if the notary public who notarized your power of attoney, authorization, affidavit or consent is active (in good standing) and whether the document was notarized properly.

Make sure the notary follows the requirements:

apostille acceptable General 3The signature of the notary public must exactly match the sample signature filed with the office of the County Clerk in the county where the notary public is qualified. This is important because if the notary's signature on the document does not match the sample signature on file with the County Clerk's office, the document will be rejected.

apostille acceptable The notary's stamp must indicate the notary's name, license number, the name of the county where the notary is qualified, and the expiration date of the notary's license. If the notary does not have an ink stamp, the above information must be printed or typed in black ink.

apostille acceptable The notary must include a Certificate of acknowledgment basically of the following form:

New York Certificate of Acknowledgment:

(for personal and corporate powers of attorney, letters, consents, copies of diplomas and transcripts signed by school officials, etc.)

State of New York     )

County of _________ )

On the . . . . . . day of . . . . . . in the year 20 . .  . . before me, the undersigned, personally appeared . . . . . ., personally known to me or proved to me on the basis of satisfactory evidence to be the individual(s) whose name(s) is (are) subscribed to the within instrument and acknowledged to me that he/she/they executed the same in his/her/their capacity(ies),

Obtaining an apostille for notarized documents in the United States can differ based on the type of document and the state where it was notarized. This page offers a clear, state-by-state breakdown of apostille requirements for notarized documents, helping you understand each step and complete the process with confidence.

California

California apostille requirements for notarized documents (sworn statements, affidavits, consents, letters, etc.)

california notary apostille

If you need to obtain a California apostille for a power of attorney, authorization, consent, or affidavit notarized by a California notary public, ensure that the document is notarized properly. Depending on the document, the notary must include either an acknowledgment or a jurat. Documents that only have a notary’s signature and stamp - without the notarial certificate - will be rejected.

Acknowledgment: The signer must personally appear before the notary to be identified and to declare that the signature on the document is their own and that they signed willingly. While it's common for the signer to sign in front of the notary, it's not always necessary; the document can be signed beforehand. The purpose of an acknowledgment is to ensure the signer is who they claim to be and has voluntarily signed the document.

Here is a sample California Certificate of acknowledgment.

Jurat: In California, a jurat is used to notarize documents where the signer is swearing to the truthfulness of the contents of the document. This typically involves an oath or affirmation administered by a notary public. Jurats are commonly used for affidavits, declarations, and other legal documents where a sworn statement is required.

Here is a sample California Jurat.

tip apostilleOnly the signer's printed name should appear on the acknowledgment and jurat forms. No title, no signer's signature.

tip apostille The acknowledgment/jurat can be on a separate page or printed on the document.

importantRemotely notarized documents: California law requires a person to appear personally before a notary public to obtain notarial acts like acknowledgments or jurats. This means the party must be physically present before the notary public. A video image or other form of non-physical representation is not a personal appearance in front of a notary public under current California State law.

importantElectronically notarized documents: California notaries public are authorized under current law to perform notarizations on documents electronically as long as all the requirements for a traditional paper-based notarial act are met, including the use of a seal for all but two specific documents used in real estate transactions.

important If multiple individuals are signing the document, the notary should notarize each signature.

importantRemotely/electronically notarized documents: are not acceptable for apostilles. To receive an apostille from the Secretary of the State in Connecticut the document in question must be signed in ink by both parties.

important If multiple individuals are signing the document, the notary should notarize each signature.

tip apostille

Connecticut state law does not require that notaries obtain and use a seal, or rubber stamp. Even though the use of a seal is optional, state law does prescribe the format of the seal to be used. The notary seal must include the notary's name as it appears on their certificate of appointment, the words "Notary Public" and "Connecticut".

tip apostille

When using the seal, the impression should be affixed near, but not over, the notary's signature. The stamp bearing the words "My Commission Expires" should be placed below the notary's signature and the notary must write in the date on which their commission expires, unless the date appears on the stamp.

Arizona apostille requirements for corporate power of attorney

arizona corporate power of attorney apostille

In Arizona, corporate powers of attorney must be notarized to be valid for apostille certification. The state allows both traditional in-person notarization and remote online notarization (RON), providing flexibility for businesses. Remote notarization enables corporate officers to sign and notarize documents online via a state-approved notary, making the process more convenient, especially for out-of-state or international business operations.

Before proceeding with an apostille, ensure the notarization meets Arizona’s notarization requirements. Below is the sample acknowledgment certificate for Arizona:

California

California apostille requirements for corporate powers of attorney

california corporate power of attorney apostille

To be eligible for a California apostille, a corporate power of attorney must be properly notarized by a California notary public and must contain an acknowledgment.

Here is a sample California Certificate of acknowledgment.

tip apostilleOnly the signer's printed name should appear on the acknowledgment form.

Corporate certificate of incumbency apostille

Do you need a Hague apostille for a corporate certificate of incumbency? Start here...

A corporate certificate of incumbency confirms the identities of a company’s officers, directors, or authorized representatives and is often required by foreign agencies for business transactions, banking, or legal matters. Since this document is issued by the company rather than a government agency, obtaining an apostille requires proper notarization.

Notarization requirements vary by state—some allow direct notarization of the original document, while others require copy certification by a notary public. Foreign Documents Express provides notarial statement and affidavit samples to ensure compliance with state regulations. This page outlines the apostille process for certificates of incumbency to help facilitate international use.

A corporate certificate of incumbency verifies a company's officers, directors, or authorized representatives. In Arizona, this document must be notarized for apostille certification. The state allows both in-person and remote online notarization (RON) by a state-approved notary, offering flexibility for businesses, especially those operating internationally.

To qualify for an apostille, the notarization must include an acknowledgment or jurat. Documents with only a notary’s signature and stamp will be rejected. For remote notarization, the notary must add: "This remote online notarization involved the use of communication technology."

Below are sample acknowledgment and jurat certificates for Arizona - either format is acceptable.

California

California apostille requirements for certificates of incumbency

california certificate of incumbency apostille

To qualify for a California apostille, a Certificate of Incumbency must be properly notarized by a California notary public and include an acknowledgment.

Remotely notarized documents have specific requirements. Read more about the apostille requirements for notarized documents (including the requirements for remote notarization) in the State of New York.....

Free document evaluationWe recommend that you email a copy of your notarized document for a free evaluation. We will advise if the document has been notarized properly, if the notary is active, and if the document is eligible for an apostille / legalization.
