New York apostille requirements for divorce records
There are two (2) types of divorce records in the State of New York.
Divorce decree. This document is prepared by the court. It details the terms and conditions of the divorce. It is signed by the judge and filed with the County Clerk, usually in the County where the plaintiff resided. If the divorce was granted before January 1, 1963, the divorce decree is the only type of document available. A copy of the divorce judgment must be certified by the county clerk before it is submitted for an apostille. In many cases, we will be able to obtain a certified copy of your divorce judgment. The requirements (eligible signatures, years of issue, etc.) vary greatly from county to county.

Divorce Certificate. This document contains basic information about the spouses, and the date and place the marriage ended. It is filed with the New York State Department of Health for divorces granted on or after January 1, 1963.
Where to get a certified copy eligible for an apostille?
To get a certified copy of a New York divorce judgment, contact the County Clerk's office in the county where the divorce was granted, as they hold the divorce judgment file. Alternatively, you can obtain a divorce certificate (different from the judgment) from the New York State Department of Health for divorces occurring in 1963 or later.
