New Jersey apostille requirements for notarized documents
In New Jersey, personal documents that may be notarized for apostille include affidavits, sworn statements, powers of attorney, travel consents, authorizations, identity confirmations, employment letters, adoption or custody consents, single status affidavits, and certain educational records like diplomas or transcripts.
To be eligible for apostilles / legalization, your document must be original (contain the original signture(s) of the signer(s)). Photocopies, digital copies, notarized copies are not acceptable for apostille purposes.
Your document must be properly notarized with the original signature and stamp/seal of the notary public. Depending on the character of the document, the notary should include either the certificate of acknowledgment (for powers of attorney, consents, authorizations) or the jurat (for sworn statements and affidavits) If there is no notarial statement on the document (just the signature and the stamp), the document will be rejected!
Vital records (birth, marriage, death certificates) and court records (divorce judgments) cannot be notarized!
Remotely notarized documents are not eligible for apostilles.
If there are more than one signer on the document, the notary should indicate whose signature(s) he/she is notarizing.
The State of New Jersey does not apostille documents where the notary's license has expired. Active notaries only.
