New Jersey apostille requirements for powers of attorney
To be eligible for apostilles / legalization, your power of attorney must be original (contain the original signture(s) of the signer(s)). Photocopies, digital copies, notarized copies are not acceptable for apostille purposes.
Your power of attorney must be properly notarized with the original signature and stamp/seal of the notary public. The notary should include a notarial statement: the certificate of acknowledgment. If there is no notarial statement on the document (just the signature and the stamp), the document will be rejected!
Remotely notarized powers of attorney are not eligible for apostilles.
If there are more than one signer on the document, the notary should indicate whose signature(s) he/she is notarizing.
The State of New Jersey does not apostille documents where the notary's license has expired. Active notaries only.
